Clinic Notice of Privacy Practices

Clinical provider: NivLux Skin & Laser, a California professional medical corporation.
Policy effective date: October 17, 2026.
Notice prepared: October 26, 2026. This date does not represent prior patient receipt.
Privacy contact: Nilika Kumar, 2 Scripps Dr, Suite 203, Sacramento, CA 95825; 916-202-4302; info@nivluxskinlaser.com.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This notice applies to the medical practice identified above and its workforce. It covers identifiable information about your health, care, and payment for care, including clinical photographs and medical records. General website and inquiry tools have separate privacy considerations and are not designated channels for submitting medical records. Additional legal protections apply to some records, as described below.

We use Aesthetic Record as our electronic medical record (EMR) service for clinical records. Our treating professionals and authorized personnel use these records to provide care and carry out the lawful purposes described in this notice. Contact Nilika Kumar at the clinic for privacy and record requests. General website chat and the consultation lead form are not the designated medical-record submission process.

Your rights

• Inspect and obtain records. Ask the privacy contact in writing to inspect your record or receive a paper or available electronic copy. We will verify identity and follow applicable access laws. California generally requires inspection within five working days and copies within 15 days of a written request, subject to lawful exceptions. Any permitted fee will follow applicable law. We will explain a denial and any available review rights.

• Request a correction. You may request an amendment to information you believe is inaccurate or incomplete. We may deny a request where the law permits, but will explain why and provide applicable disagreement or addendum rights.

• Request confidential communications. Ask us to contact you in a particular reasonable way or at a different location, such as a specific telephone number or mailing address.

• Request limits. Ask us to limit certain uses or disclosures for treatment, payment, or operations. We do not have to agree to every request. If you pay in full out of pocket for an item or service, we must honor a request not to disclose related information to your health plan for payment or operations unless law requires disclosure.

• Receive an accounting. Ask for an accounting of disclosures covered by this right during the prior six years. It excludes treatment, payment, operations, authorized disclosures, and other legally excluded categories. One accounting in a 12-month period is free; we will tell you about any permitted additional fee.

• Receive this notice. Request a paper copy at any time, including if you received it electronically.

• Use a representative. A legally authorized personal representative may exercise applicable rights after we verify authority, subject to legal exceptions.

Questions and complaints

Contact the privacy official above with questions or a complaint. You may also complain to the U.S. Department of Health and Human Services Office for Civil Rights at www.hhs.gov/hipaa/filing-a-complaint/index.html, by telephone at 1-877-696-6775, or by writing to 200 Independence Avenue, S.W., Washington, D.C. 20201. We will not retaliate against you for exercising privacy rights or making a complaint.

How information may be used or shared

Treatment, payment, and health care operations

Subject to applicable law, we may use and share information to provide and coordinate your care, such as with a treating physician or pharmacy; collect payment for services, such as processing a bill; and operate the practice, such as quality review, staff training, scheduling, and necessary service communications. A reference to an allowed use does not mean the practice performs every example or accepts every insurance plan.

Service providers assisting the practice may receive information needed for their work under the agreements and safeguards required by law. The minimum-necessary rule applies where legally required. For a service paid in full out of pocket, see your right to restrict certain health-plan disclosures.

Family, others involved in care, and emergencies

Where law permits, we may share relevant information with people involved in your care or payment when you agree, have an opportunity to object and do not object, or where a professional judgment exception applies. We may share limited information for disaster relief or to lessen a serious and imminent threat as law permits. We follow applicable restrictions for minors and personal representatives.

Other legally permitted or required purposes

Where the conditions of the relevant law are satisfied, information may be disclosed for public health and safety, product recalls, adverse-event reporting, abuse or neglect reporting, health oversight, workers’ compensation, lawful law-enforcement requests, judicial or administrative proceedings, research, organ or tissue donation, coroners or funeral directors, or special government functions. We may disclose information as required by law, including for privacy-law enforcement. A subpoena or request alone does not eliminate other legal confidentiality requirements.

Written authorization and your choices

Uses and disclosures outside this notice and outside other lawful permissions require your written authorization. Marketing uses requiring authorization, sale of protected health information, most disclosures of psychotherapy notes, and public use of identifiable patient photographs require the appropriate authorization unless a specific legal exception applies. Optional marketing contact preferences do not substitute for a medical-information authorization.

You may revoke an authorization in writing, except to the extent action has already been taken in reliance on it or another legal exception applies. Revocation does not erase existing medical records. Where applicable, you may opt out of fundraising communications. If Part 2 records would be used for fundraising, advance clear notice and a choice are required.

More protective confidentiality laws

California medical-confidentiality law and other applicable laws can require authorization or narrower disclosures than HIPAA, including for certain mental health, HIV, genetic, reproductive health, or minor-consented services. We apply the more protective rule where required. General permissions in this notice do not override those protections.

If we receive substance use disorder patient records protected by 42 CFR Part 2, we apply the additional Part 2 protections. Those records cannot be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your specific consent or a qualifying court order and subpoena or other legal mandate required by Part 2. Applicable restrictions on redisclosure continue to apply; a general permission elsewhere in this notice does not remove them.

Our responsibilities and changes to this notice

Our responsibilities

We are required by applicable law to protect the privacy of your health information, provide this notice, and follow the notice currently in effect. We use safeguards required by law and provide required notification if a breach of unsecured protected health information occurs. We do not use or share information outside the permissions described here unless another lawful permission applies or you authorize it in writing.

Where HIPAA permits, information disclosed to a recipient that is not subject to HIPAA may be redisclosed and may no longer be protected by HIPAA. Other laws, including California law and Part 2 where applicable, can still restrict use or redisclosure.

Changes to this notice

We may revise this notice as law permits. The revised notice may apply to information we already hold as well as future information. The current notice and its effective date will be available from the clinic, on our website, and on request. Contact the privacy official if you need a copy or help exercising a right.
